Warning Letter

What is a warning letter (Abmahnung)? A warning letter is a written request from the employer to an employee to refrain from particular behaviour or to fulfil a contractual (secondary) duty. It also contains the notice that, in the event of a repetition of the breach of duty, employment-law consequences threaten and dismissal may even be possible. However, not every letter from the employer constitutes a permissible warning, even if it is headed “Abmahnung”. On the other hand, a warning need not necessarily be designated as such.
