What is the Narcotics Act (BtMG)?
The BtMG regulates the handling of narcotic substances and the raw materials from which they can be obtained. It covers their acquisition, possession, trade, manufacture, import, export and dispensing. The substances are listed in three annexes; their handling requires a permit, with limited exceptions (e.g. for medical purposes).
What offences are punishable under the BtMG?
The most frequent charges concern: possession of narcotics (§ 29 BtMG), trafficking in narcotics, supply to minors, illegal importation, cultivation, manufacture and dealing in non-minor quantities (§ 29a, § 30, § 30a BtMG). The penalty range extends from a fine to imprisonment of up to 15 years for the most serious offences.
How we defend you
We examine the legality of the police measures, the seizure of evidence and the chain of custody. We assess whether the quantity reaches the threshold of a non-minor quantity, whether intent can be established and whether mitigating circumstances (own consumption, low quantity, cooperation) apply. Where appropriate, we negotiate a discontinuation of proceedings under § 153a StPO or § 31a BtMG.
