What is a house search?

If a person is suspected of being involved as a perpetrator or participant in an offence — for example handling stolen goods, data fencing, favouring an offender or obstruction of justice — the police may, under certain conditions, conduct a search of their premises. The search aims to find evidence and seize objects relevant to the proceedings.

Your rights during a search

  • You have the right to remain silent — make no statement to the police without your lawyer.
  • You may demand that the search warrant be shown to you and read carefully.
  • You can ask for a witness of your choice to be present.
  • You can object to specific seizures (the objection will be recorded in the search log).
  • Do not actively support the search beyond what is legally required.
